The Irish government recently provided estimated processing times for employment and Irish Residence permit applications.

Employment Permits:

  • The average processing time for employment permits at the Immigration Services Registration Office is approximately one week.
  • Processing times for employment permits may increase to approximately three weeks over the holiday season.

Irish Residence Permits:

  • The average processing time to renew an IRP card at the Immigration Services Registration Office is approximately six to eight weeks.
  • Foreign nationals should expect to wait an additional two weeks to receive the new IRP card after completing the renewal process.
  • Foreign nationals whose IRP card has expired and are unable to renew their card by its expiration date are allowed to stay in the country for eight weeks on the expired card.
  • Foreign nationals are not allowed to stay in the country on an expired IRP card if they have not made any effort to renew it.

Additional Information: Once the IRP renewal application has been approved, authorities will send an email to the applicant. This email can be used as proof of registration while the applicant waits for their new IRP card.

The Dutch government announced that it will increase the statutory minimum wage by more than 10% in 2023.

Key Points:

  • The statutory minimum wage for full-time employees who are 21 and older will increase from €1,756.20 to €1,934.45 per month on Jan. 1, 2023.
  • The current minimum wage for all ages is available here.
  • Minimum wage requirements for work-related residence permits remain unchanged by the Jan. 1, 2023, increase.

Additional Information: The minimum wage is mostly relevant for those who want to sponsor dependent permits and to workers over the age of 21, including employee cardholders, whose wages cannot be lower than the minimum wage. Foreign workers must be paid above the minimum wage.

BAL Analysis: Businesses may see a slight increase in labor costs because of the new minimum wage. Employers should take the new wage minimums into account when planning their 2023 budgets.

The Irish government has removed Russia and Belarus from its Short-Stay Visa Waiver Program.

Key Points:

  • Russian and Belarusian nationals can no longer enter Ireland using previously issued U.K. short-stay visas.
  • Irish authorities continue to assess visa applications from Russian nationals on a case-by-case basis.
  • The Short-Stay Visa Waiver Program allows nationals of certain countries who hold a short-stay U.K. visa to travel to Ireland without obtaining an Irish visa.

Additional Information: Irish authorities will not recognize Russian passports issued in occupied foreign regions, including Ukraine and Georgia, when issuing visas or for those crossing borders. However, individuals holding Russian passports issued in controlled regions can still apply for asylum and remain entitled to Temporary Protected Status.

The Irish government has confirmed that it will permanently issue employment permits electronically.

Key Points:

  • As of Sept. 1, foreign nationals will receive electronic employment permits rather than hard-copy permits.

The Irish government has announced it will publish a new law to modernize its employment permit system.

Key Points:

  • Foreign nationals will be able to apply for a new Seasonal Employment Permit if they will be working in Ireland during reoccurring short-stays.
  • Irish authorities will revise the labor market needs test with the intent to make it more relevant and efficient.
  • Salary requirements will be linked to price indexes to ensure foreign national’s wages remain close to wage growth in Ireland.
  • Provisions will be introduced for subcontractors registered in Ireland to have access to the employment permits.

Additional Information: The employment permits system is managed through lists designating critical skills and ineligible occupations. The Irish government has announced that it has temporally suspended visa-free entry for refugees traveling from “safe” European countries for 12 months.

Key Points:

  • As of July 18, refugees who hold Convention Travel Documents must apply for a visa to travel to Ireland for less than 90 days.
  • Visa-free travel remains available to Ukrainian nationals.
  • Individuals who have been granted refugee status in other counties can still apply for a visa to travel to Ireland.

The Irish government has suspended the issuance of re-entry visas for children under the age of 16.

Key Points:

  • As of June 15, foreign nationals under the age of 16 can now travel with a parent or legal guardian who legally lives in Ireland without having a re-entry visa.
  • Accompanying adults must provide sufficient documentation, such as a birth or adoption certificate, to prove that they are the legal parent or guardian of the child when entering or exiting Ireland.
  • Re-entry visas applications for children under the age of 16 that were pending as of June 15 will be canceled and applicable documents will be returned to the applicant.

The Irish government recently updated its Critical Skills Occupations List and increased quotas for certain professions.

Key Points:

  • Cardiac physiologists, medical scientists, occupational therapists, pharmacists, physiotherapists, podiatrists/chiropodists, psychologists and speech and language therapists are now eligible for Critical Skills Employment Permits.

  • Authorities increased the permit quotas for Meat Processing Operatives to 425.
