What is the change? The National Immigration Council has published Normative Resolution 26, which establishes residence authorization requirements for internship programs for foreign graduate and post-graduate students as well as recent graduates. The categories were previously regulated by NR 94 (Professional Exchange) and NR 103 (Summer Job).
What does the change mean? Effective immediately, these regulations list details and documents required to get a temporary residence approved by the Brazilian Ministry of Labor for internship programs.
BAL Analysis: The new Normative Resolution, published Monday, confirms an important scenario under the New Immigration Law, allowing temporary residence authorization granted by the Brazilian Ministry of Labor for students and recently graduated applicants to come to Brazil for a professional internship program. The resident authorization can be granted for 90 days (during the vacation period of the university schedule) or one year (for recently graduated students), but they cannot be extended. In both cases, a contract is required between the Brazilian host company, the intern, and an organization that operates the internship program.
