IMPACT – MEDIUM

What is the change? South Korea has tightened regulations for foreign nationals exiting the country who are non-compliant with visa requirements.

What does the change mean? Foreign employees who are non-compliant with visa requirements will have to submit a “Statement of Voluntary Departure of Irregular Immigrants” three to 15 working days before leaving the country.

  • Effective date: Oct. 14.
  • Who is affected: Foreign nationals out of compliance with their visas.
  • What’s next: The change will go into effect next Monday.

Background: The change is part of a government initiative to ensure that non-compliant foreign nationals are subject to stricter criminal screenings before their departure.

Analysis & Comments: While the change will impact foreign nationals who are non-compliant with visa regulations, foreign nationals with valid visas and work permits will not be affected by the new rule, and exit requirements for compliant foreign employees remain the same.
