IMPACT – MEDIUM

What is the change? Slovenia has implemented the European Union’s directive on intra-corporate transferees.

What does the change mean? Non-EU managers, experts or trainees who are transferred within the same group of companies to a Slovenia office may apply for ICT permits, and holders of EU ICT permits issued in another EU country may be transferred to an affiliated office in Slovenia for up to 90 days by notifying labor authorities or, for longer than 90 days, by applying for a long-term ICT permit.

  • Implementation time frame: Immediate.
  • Visas/permits affected: ICT permits.
  • Who is affected: Non-EU managers, experts and trainees who are transferred to Slovenia from within the same group of companies.
  • Impact on processing times: ICTs holding an EU ICT permit from another EU country do not need to apply for a new permit but must notify authorities within eight days of transferring to Slovenia for stays of up to 90 days. For transfers of longer than 90 days, they must apply for a long-term permit but may start work immediately without waiting for approval.
  • Business impact: ICTs transferred to Slovenia will benefit from implementation of the ICT permits and have greater mobility for transfers within the EU.

Background: The EU directive on ICTs, adopted in 2014, unifies rules for non-EU nationals who are transferred within the same corporate group and creates streamlined processes for ICT permit holders moving among multiple EU countries for short-term and long-term assignments.

The Slovenia ICT work and residence permit has a duration of one year for managers and experts and is renewable for a maximum duration of three years. The ICT permit for trainees has a maximum duration of one year.

BAL Analysis: Slovenia’s implementation of the EU directive enhances mobility for ICTs and reduces processing for those already holding an ICT permit in another EU country.
