The EB-5 Immigrant Investor Program is an immigrant visa program that allows foreign national investors to apply for lawful permanent residence in the United States by investing in a U.S. enterprise and creating jobs for U.S. workers.

Foreign national investors, including their spouses and unmarried children under 21, are eligible to apply for lawful permanent residence (obtain a Green Card) if they:
1. Make the required minimum investment in a new commercial enterprise in the U.S.
2. Create or preserve 10 permanent full-time jobs for qualified workers in the U.S.
There are two options for an EB-5 investment:
1. A direct investment in a new commercial enterprise.
2. A regional center investment, which is a business entity authorized by U.S. Citizenship and Immigration Services (USCIS) to pool EB-5 capital.

Regional centers are public or private economic units in the United States designated by USCIS to promote economic growth. They allow investors to count indirect or induced jobs to fulfill the EB-5 job creation requirement. A list of currently approved EB-5 regional centers can be found here.
The 2022 EB-5 Reform and Integrity Act created EB-5 visa set-asides for qualified investors who invest in specific types of projects.
Any unused set-aside visas are held in the same category for one more fiscal year. After the second fiscal year, any unused set-aside visas are released to the unreserved EB-5 visa numbers during the third fiscal year.
