Spain | Government approves measure granting legal status to foreign nationals, effective April 16

The Ministry of Inclusion, Social Security and Migration approved a royal decree granting residence and work authorization to foreign nationals currently residing in Spain, effective April 16, 2026. As previously reported, the measure underwent a public comment period after the initial announcement.

According to the measure, foreign nationals currently residing in Spain are eligible for a residence permit if they meet the following requirements:

• Prove stay in Spain began before Jan. 1, 2026
• Demonstrate proof of continuous residence in Spain for at least five months prior to submitting the application
• Hold no criminal record nor pose a threat to public order, public safety or public health
• Applied for international protection or are in an “irregular administrative situation”

Individuals meeting these requirements will receive legal residence and work permits valid for one year, after which they must apply for standard residency status under current immigration regulations. Minors are eligible for a five-year residence permit.
