Update: most AEP applicants can continue using third parties

Authorities in the Philippines continue to allow most Alien Employment Permit applicants to use third parties to submit their applications despite an earlier advisory that indicated this practice would end in October.

Key points:

• In September, the Department of Labor and Employment released an advisory saying that beginning Oct. 1, foreign nationals applying for AEPs would be required to make an in-person appearance to submit their application or pick up their AEP card.
• Under a subsequent advisory, however, authorities have continued to allow the use of third parties for most AEP applications.
• Philippine Offshore Gaming Operators (POGOs) are subject to different rules. POGOs are no longer to use third parties to submit AEP applications. Company representatives can submit applications and the employee must make an in-person appearance to retrieve the AEP card once it is approved.

Analysis & Comments: Most companies in the Philippines can continue to follow their previous practices for AEP application submission and pick-up. POGOs should take note of the change and coordinate with foreign employees on both the submission of AEP applications and the retrieval of AEPs.
