United States | USCIS revises M-274 Employer Handbook, reflecting changes to TPS-based EAD extensions

U.S. Citizenship and Immigration Services has revised sections of the M-274, Handbook for Employers, to reflect changes affecting the length and availability of automatic extensions for certain Employment Authorization Documents (EADs) based on Temporary Protected Status (TPS).

Key takeaways:

Certain EAD automatic extension periods eliminated. Various regulatory and policy developments have either reduced or eliminated the length and availability of automatic extensions of TPS-based Forms I-766, Employment Authorization Documents, for qualifying TPS applicants and beneficiaries.

M-274, Handbook for Employers, updated accordingly. Sections 5.0 through 5.3 of the M-274, Handbook for Employers, have been revised to reflect these regulatory changes. The handbook can be viewed here.

Additional information: These updates stem from recent Federal Register notices, a Department of Homeland Security interim final rule effective Oct. 30, 2025, and USCIS implementation of the One Big Beautiful Bill Act (H.R. 1) in July 2025.
