Immigration News - Employment Visas, immigrant visas, United States United States | EB-3 and EW visa cap limit reached for FY 2025 Share this article LinkedIn Facebook X (Twitter) September 10, 2025 The Department of State announced on Sept. 9, that the annual limit for Employment-Based Third Preference (EB-3) immigrant visas and the “Other Workers” (EW) subcategory has been reached for fiscal year (FY) 2025. Key Points: All available EB-3 and EW visas for FY 2025 have now been issued, and embassies and consulates will no longer issue EB-3 and EW visas for the remainder of the fiscal year. The Immigration and Nationality Act (INA 203(b)(3)) mandates the EB-3 annual cap limit is set at 28.6% of the worldwide employment limit, of which up to 10,000 may be used for EW visas. EB-3 and EW visa issuance will resume on Oct. 1, 2025, when the FY 2026 annual limits are reset. This alert has been provided by the BAL U.S. Practice Group.
